Whether you can deduct losses from selling at a loss on OKX depends on your tax jurisdiction. The U.S. Internal Revenue Service (IRS) treats cryptocurrency as property, not securities. This classification determines a rule that is currently quite favorable for investors under U.S. tax law: the Wash Sale Rule does not apply to cryptocurrency.

The Basic Logic of Deducting Losses
When you sell for less than your purchase cost (cost basis), you incur a capital loss. This loss can be used to offset capital gains in the same tax year. If your losses exceed your gains, you can use up to $3,000 of the loss to offset ordinary income each year, and any remaining loss can be carried forward to future tax years.
Repurchase Restrictions: No 30-Day Waiting Period Right Now
For stocks and securities, the IRS Wash Sale Rule states that if you buy back the same or substantially identical asset within 30 days before or after selling at a loss (a 61-day window), that loss cannot be used to reduce your taxes.
However, cryptocurrency currently does not fall under this rule. Because the IRS classifies crypto assets as property, and the text of the Wash Sale Rule only mentions "stock or securities." Recent court decisions have also tended to follow a textualist approach—courts will not add things that are not written in the law.
This means that under current U.S. tax law, you can sell a token at a loss on OKX and immediately buy it back, and that loss can still be used to reduce your taxes.
But the "Economic Substance" Doctrine Still Applies
Not having a Wash Sale Rule does not mean you can create unlimited losses. The IRS can still challenge transactions that are done solely to create tax deductions without a real economic purpose under the economic substance doctrine.
If you sell and buy back within seconds, and your account's risk exposure has not changed in any real way, the IRS may argue that this is not a "bona fide loss" and deny the deduction. Tax experts have clearly stated: "The absence of a Wash Sale Rule is not a loophole to exploit, but a tool that must be used responsibly."
A Key Change for the 2026 Tax Season
Starting January 1, 2026, OKX, as a digital asset broker, will be required to report cost basis on Form 1099-DA for "covered securities" (assets purchased on OKX and sold in 2026 or later).
Before that (for the 2025 tax year), Form 1099-DA only reports gross proceeds, not cost basis. This means the IRS will see how much you sold, but not your purchase cost. Starting in 2026, cost basis will also be reported, allowing the IRS to directly verify whether your reported gains or losses are accurate.
The impact on loss deductions: your filing must match the data on the 1099-DA. If the cost basis reported by OKX does not match your own calculation (for example, if you moved assets to an external wallet and then back), the IRS may send a notice for reconciliation.
Other Tax Jurisdictions
Rules outside the U.S. vary widely. Japan is moving toward a flat 20% tax rate on crypto gains, aligning with stocks. Spain is considering raising the tax rate on crypto gains and classifying crypto assets as seizable assets.
If you are not in the U.S., you need to check the specific rules in your tax jurisdiction. Whether the Wash Sale Rule applies to crypto, whether losses can offset income, and whether there are annual limits all differ from place to place.
Back to Your OKX Activity
If you are a U.S. tax resident: under current tax law, selling at a loss is deductible, and there is no 30-day waiting period restriction on buying back. But do not engage in "circular trading" purely to create losses; maintain a genuine investment intent. Starting in 2026, OKX's cost basis reporting will make it easier for the IRS to verify your filing.
If you are in another region: check local rules first. The fact that the Wash Sale Rule does not apply to crypto is a U.S.-specific situation and does not mean it applies globally.
