Can European users enjoy a 14-day cooling-off period when buying crypto on OKX?

No. European users who buy crypto on OKX through the spot market do not benefit from the 14-day right of withdrawal under Article 13 of MiCA. This right has a key exclusion: if the relevant crypto asset has already been admitted to trading on a trading platform before the retail purchase, the 14-day withdrawal right no longer applies. OKX is a licensed exchange, and all spot trading pairs listed on it are considered "admitted to trading" assets. The moment you click buy and the order is filled, the contract is fully performed, and there is no legal channel to reverse or withdraw the trade afterwards.

What scenarios does the 14-day withdrawal right actually cover?

The right under Article 13 of MiCA is designed for primary market issuance, not secondary market trading. The text of the provision limits its application to retail holders who purchase crypto assets "directly from the issuer or from a crypto-asset service provider placing the crypto-assets on behalf of the issuer." In other words, when a project first issues tokens to the public and you participate through a subscription, the law gives you 14 calendar days to change your mind. After withdrawal, the issuer must refund all the money you paid within 14 days of receiving notice, with no fees and no questions asked.

Once that token is admitted to trading on a trading platform, the withdrawal right disappears. On OKX's European platform, every coin you can buy or sell at market or limit price is in an "admitted to trading" state. When you place a buy order, your counterparty is another seller in the market, not the issuer. The trade is completed at the moment orders are matched, and there is no window for you to unilaterally "rescind the contract."

The withdrawal right in OKX's European terms is not the same as buying crypto

OKX Europe Market Ltd's terms of service do contain language about a "right of withdrawal," but it applies to the remote service contract between you and OKX, not to the crypto assets you purchase. The terms explicitly exclude several situations, including one where you have already placed an order or accepted services related to price fluctuations in financial markets during the withdrawal period. In that case, the withdrawal right no longer applies.

When you buy crypto on OKX, you are precisely "placing an order and accepting services related to price fluctuations." So even if you try to invoke the withdrawal right under the terms of service, it will be excluded because the trade has already been executed. The practical use of this clause is closer to: you registered an account but have not used any trading functions, and under certain conditions you might claim to terminate the service relationship—not to cancel a spot buy order that has already been filled.

What can you do if you change your mind after buying?

The statutory withdrawal right is not available, so the remaining path is regular trading operations. If you change your mind after buying, you can sell on the spot market. The selling price depends on the order book at that moment and may be higher or lower than your purchase price. The difference and fees are your responsibility. This is fundamentally different from a "withdrawal right": a withdrawal right is an unconditional return right granted by law, where the seller must refund the original payment. Selling is a new trade that you initiate as a market participant, and you bear the profit or loss yourself.

If your purchase was made through OKX's fiat gateway or C2C, the rules are different. C2C is trading between users, and OKX provides escrow and dispute resolution mechanisms, but the MiCA issuance subscription withdrawal right does not apply. Once a C2C order releases the crypto, cancellation depends on the seller's willingness and the platform's dispute intervention, not on a statutory 14-day window.

One exception worth noting

The withdrawal right under MiCA Article 13 only applies to "crypto-assets other than asset-referenced tokens and e-money tokens." Stablecoins (asset-referenced tokens or e-money tokens) are not covered by the 14-day right in the first place. Even if you participate in the initial issuance subscription of a token, if that token falls into the stablecoin category, this right does not apply. Buying USDT, USDC, or other stablecoins on OKX's European platform—whether in the primary or secondary market—never comes with a 14-day cooling-off period.
