In Binance Japan, buying BTC cannot receive NISA tax exemption. NISA's tax-exempt targets are financial products such as stocks, investment trusts, and ETFs, while crypto assets like BTC themselves are not within NISA's investment scope. Buying spot BTC through Binance Japan's regular trading account generates profits that, under Japan's current tax system, are classified as miscellaneous income. They must be combined with salary and other income for tax calculation and do not enter the NISA framework.

NISA's boundary: only "securities" are recognized, not crypto assets
In the Japan Financial Services Agency's explanation of NISA-eligible investment products, the growth investment quota covers listed stocks, public investment trusts, and similar products, while the accumulation investment quota covers investment trusts that meet certain conditions. The National Tax Agency's new NISA explanation table similarly lists listed stocks, ETFs, and public stock investment trusts as eligible, with no mention of crypto assets. Under the current legal framework, spot BTC is a crypto asset under the Payment Services Act, not a security under the Financial Instruments and Exchange Act, so it cannot be placed in a NISA account for purchase.
Here we need to distinguish a confusing point in time. After the Financial Instruments and Exchange Act amendment was passed in July 2026, crypto assets were positioned as "financial products," paving the way for future deregulation of crypto asset ETFs and tax system adjustments. But ETFs and spot assets are two different things: even if a Bitcoin ETF is listed in Japan in the future and included in NISA, what you can buy in a securities account is ETF shares, not spot BTC on Binance Japan. Binance Japan's spot trading will not become NISA-eligible just because of the Financial Instruments and Exchange Act amendment or future changes to the ETF system.
Actual tax treatment when buying BTC through Binance Japan
Buying and holding BTC on Binance Japan does not generate any tax liability during the holding period. When selling BTC for Japanese yen, exchanging BTC for other crypto assets, or using BTC to pay for shopping, the profitable portion will be taxed. The National Tax Agency's guidance clearly states that profits generated from selling or using crypto assets are, in principle, classified as miscellaneous income and require final tax return filing. MUFG Bank's explanation also confirms that crypto asset trading profits are, in principle, included in comprehensive taxation as miscellaneous income, with tax rates increasing progressively according to income level. High-income earners may face relatively high tax burdens.
If you are a salaried employee, and your total miscellaneous income other than crypto assets does not exceed 200,000 yen per year, you may not need to file a final tax return, but resident tax filing may still be required. This 200,000 yen threshold is a "no filing required" threshold, not a "tax exemption" threshold. Holding BTC on Binance Japan without selling will not trigger taxation; once you sell, you need to calculate it as miscellaneous income.
So what are the discussions about "NISA and crypto assets" actually about
Most discussions about crypto assets and NISA in the market point to two directions that have either not yet materialized or have materialized but are unrelated to you. One is that if crypto asset ETFs are included in NISA in the future, buying ETFs through a securities account may enjoy tax exemption, but this requires government ordinance amendments and specific product listings. As of October 2026, domestic crypto asset ETFs in Japan have not yet been deregulated, and NISA applicability has not been determined. The other is that Japan is discussing changing the crypto asset tax system from miscellaneous income to separate self-assessment taxation at 20%, but this changes the tax rate and filing method, not putting spot BTC into NISA. Buying BTC on Binance Japan has no NISA channel under the current system.
If what you want is "tax-exempt or low-tax BTC exposure"
A more practical path is to wait until crypto asset ETFs are launched in Japan, then purchase eligible ETFs through a securities company's NISA account. What you give up is direct control over private keys and the flexibility of 24-hour trading; what you gain is possible NISA tax exemption treatment and the convenience of tax handling in a securities account. If you insist on holding spot assets on Binance Japan, you need to accept miscellaneous income taxation and final tax return filing obligations, while keeping good transaction records for profit and loss calculation. Do not assume that buying BTC on an exchange is already or will soon be eligible for NISA just because you see news about "Financial Instruments and Exchange Act amendment" or "crypto asset financial productization."
