Vietnamese users can still log in and use Binance at the moment, but "being able to use it" and "being compliant" are two different things. As of November 2026, Vietnam has not issued a formal operating license to any cryptocurrency exchange, including local applicants, and Binance has not obtained a local license in Vietnam. The fine provisions targeting individual users who trade on unlicensed platforms have been written into the decree, but the trigger conditions have not been met yet — the six-month countdown for fines only begins after Vietnam's Ministry of Finance issues the first exchange license. So for now, your Binance account will not be directly penalized by Vietnamese regulators, but this window will not stay open forever.

Where Vietnam's Rules Are Stuck
Vietnam's regulatory framework consists of Resolution No. 05/2025/NQ-CP from 2025 (a five-year pilot program) and Decree No. 284/2026/NĐ-CP, which took effect on September 1, 2026. The decree states that domestic investors who trade digital assets through service providers not licensed by the Ministry of Finance face individual fines of 30 million to 50 million Vietnamese dong. Enforcement of this provision has one precondition: it only applies to individual users six months after the first local exchange receives a formal license.
Vietnam's Ministry of Finance opened license applications in January 2026, and five local companies passed the initial assessment, including VIX, Techcom, and CAEX, which is linked to VPBank. However, passing the initial review is not the same as receiving a license. According to public information from late August to October 2026, no company has received final approval, and Vietnamese authorities have not announced a licensing timeline. After licensing, approved companies still need to complete all compliance requirements — capital, IT systems, risk controls — within one year before they can actually begin operations.
This means fines for individual users are currently in a "written but not yet effective" state. Your trades on Binance will not be penalized simply because of the September 1 date itself. But if you interpret "not punished for now" as "never a problem," you would be making the wrong judgment.
Why Binance Is Not on Vietnam's License List
Vietnam's pilot rules limited eligible participants from the start: applicants must be enterprises registered in Vietnam, with a minimum paid-in registered capital of 10 trillion Vietnamese dong (about 380 million USD), foreign ownership capped at 49%, and at least 65% of capital coming from institutional shareholders. As an overseas exchange, Binance does not structurally qualify to apply. There is also no public information showing that Binance has established a local entity in Vietnam that meets the capital and ownership requirements to apply for a license.
Binance's activities in Vietnam follow a different track: starting in March 2026, employees from Binance's local Vietnam team withdrew from community support groups, while the platform posted a job opening for a Vietnam General Manager, requiring more than ten years of experience and familiarity with local regulatory relationships. These moves can be understood as maintaining market presence and exploring partnership possibilities, but they do not equal regulatory approval. Based on currently available public information, Binance's licensing status in Vietnam has not changed.
What You Should Check Now
If you hold a Binance account and live in Vietnam, checking your actual status is more useful than guessing about policy direction.
First, confirm your account registration country and KYC information. Binance's terms of service and product availability depend on the country of residence you declared when completing identity verification. If you registered with Vietnamese information, Binance's product pages will reflect the restrictions that apply to that region. If you have moved to another country and updated your KYC, different rules will apply. Open the security or verification page in your Binance account and check whether the currently registered country/region matches your actual tax residency.
Check the features you actually use. The restrictions under Vietnam's pilot framework mainly target transactions conducted through unlicensed local service providers. The availability of Binance's spot, futures, P2P, and Earn products in Vietnam depends on what actually appears on your screen after logging in, not on any tutorial or community post. If a feature page shows a regional restriction, that feature is unavailable for your current account status. There is no need to try repeatedly or look for "workarounds."
Watch for changes in VND deposit and withdrawal channels. Vietnam's regulatory direction is to push trading toward settlement in Vietnamese dong through licensed local institutions. If your main need is buying and selling crypto with VND, the availability and cost of Binance P2P or third-party payment channels may change once local exchanges begin operating. You do not need to migrate in advance, but it is worth confirming the actual availability of your current channels before every large transaction, rather than assuming that what worked last month will still work this month.
A Risk Boundary Worth Noting
There is a category of provisions in the Vietnamese decree that takes effect immediately and does not wait for the licensing countdown: providing or advertising crypto services without a license, illegally collecting or disclosing user account data, and similar acts can be penalized starting September 1, 2026. For ordinary users, the likelihood of directly triggering these provisions is very low. However, if you participate in community operations, do signal groups or referrals, or promote overseas platforms locally in any form while in Vietnam, your role shifts from "user" to "service provider or promoter," and different rules apply. In an environment of tightening regulation, the line between purely personal use and operating for others is worth understanding clearly.
