Whether your business needs a MiCA license does not depend on which country you are registered in. It depends on what services you actually provide and who you provide them to. After July 1, 2026, providing crypto-asset exchange, custody, trading platform operation, order execution, transfer, and other services to clients in the EU generally requires CASP (Crypto-Asset Service Provider) authorization. But "registering a company in the EU" does not automatically mean you need a license, and "doing crypto business" does not necessarily fall under MiCA. The key is whether your service belongs to the categories listed in MiCA and whether you are actively marketing to EU clients.

First, check which MiCA category your business falls into
MiCA divides services by function. It is not a single "universal crypto license." The following services require CASP authorization: custody and administration of crypto-assets on behalf of clients, operating a crypto-asset trading platform, exchange of crypto-assets for fiat currency, exchange between different crypto-assets, execution of client orders, placing of crypto-assets, reception and transmission of orders, providing crypto-asset investment advice, and providing crypto-asset portfolio management. If your business only develops on-chain protocols, writes code, or does audits, and does not directly provide the above services to clients, you usually do not need a CASP license. But if you operate a front-end interface that lets EU users exchange tokens or deposit assets through it, you need to carefully assess whether it constitutes "exchange" or "custody."
Stablecoin issuance is a separate track. Issuing asset-referenced tokens (ARTs) or electronic money tokens (EMTs) requires separate authorization. A CASP license does not cover it. ART issuers must be EU entities and meet own funds requirements (at least EUR 350,000 or 2% of the average amount of reserve assets, whichever is higher). Currently, ESMA's ART register is still empty, while the EMT register has 43 entries. If you only use stablecoins for payments or settlement and do not issue them, this layer does not apply to you.
Crypto-assets that qualify as financial instruments are not governed by MiCA. If a token has security-like characteristics, existing financial regulations such as MiFID II apply. You would need an investment firm license, not a CASP license. This determination must be made at the level of the specific token's economic design, not based on labels.
The transition period has ended, old registrations no longer work
The longest transition period MiCA granted to existing service providers ended on July 1, 2026. A VASP registration previously obtained in a member state can no longer serve as the basis for operating in the EU. As of May 2026, there were about 194 authorized entities (including banks) across the EU, while according to 2024 data there were more than 3,000 registered entities. The gap means that many platforms that previously operated under old registrations lost their legal basis to operate after the transition period.
For new entrants, the path is actually simpler: plan directly according to MiCA's CASP authorization requirements. You do not need to consider "transitioning with an old registration first." If you already have a VASP registration in a member state but have not yet obtained MiCA authorization, you now need to either stop providing unauthorized services to EU clients or complete the CASP application.
Checks before opening an account: three questions determine your path
First question: Who do you plan to provide services to? If you actively market to EU clients, provide an interface, or accept registrations, MiCA's territorial jurisdiction will cover you. MiCA strictly limits the "reverse solicitation" exception, making it difficult for non-EU entities to rely on offshore structures for passive client acquisition. If all your clients are outside the EU and you have no marketing activities targeting the EU market, in theory MiCA is not triggered. But there is a gap between "in theory" and "regulatory determination." You need to assess based on your actual marketing channels and user composition.
Second question: Is your service on the MiCA list? Compare against the service types listed above. A common misjudgment is mixing "technology development" with "service provision." Writing an exchange contract is different from operating an interface that lets users exchange through it and charging fees.
Third question: Are you an institution that can use the simplified procedure? If you are already an EU-licensed credit institution, investment firm, electronic money institution, UCITS management company, or AIFM, you can obtain crypto-asset service qualification through the notification procedure under Article 60 of MiCA, rather than going through the full CASP application. The notification procedure requires submitting information to the competent authority at least 40 working days in advance, and the competent authority checks completeness within 20 working days. This path is faster than a full application, but only if you already hold the relevant financial license.
If you do need CASP authorization, what to prepare
The core material of a CASP application is not a single form. It is a system that proves you can "operate in continuous compliance." The competent authority will look at: where the registered office and actual management of the EU entity are located; whether at least one director is in the EU; whether management has the appropriate knowledge and experience; whether you have established systems for client asset segregation, conflict of interest management, complaint handling, outsourcing risk management, and orderly wind-down plans; and your anti-money laundering and counter-terrorist financing policies and procedures. Own funds requirements depend on the type of service. The baseline is the fixed minimum capital in Annex IV or one quarter of the previous year's fixed overheads, whichever is higher.
Application rejection is a real risk. In October 2026, Germany's BaFin rejected the MiCA application of futurum bank AG, a subsidiary of Bitcoin Group SE, on the grounds that the regulator considered the "implementation and operationalization of measures" insufficient. The company operates the Bitcoin.de platform, which has more than 1.1 million registered users. Trading has largely been suspended since June. An application is not just a procedural step. Regulators will substantively review whether your compliance system is actually functioning.
A scenario that needs distinction: you only use crypto for payments
If your business accepts crypto-assets from clients as payment for goods or services, rather than providing crypto-asset exchange, custody, or trading services, CASP requirements are usually not triggered. MiCA regulates "service providers," not "merchants that accept crypto payments." But if you actively convert received crypto-assets into fiat after payment and this becomes a main part of your business, whether that conversion activity constitutes a service requiring authorization depends on the manner and frequency of the conversion.
Completion standard: what counts as "assessment complete"
It is not "having looked up the MiCA provisions." It is being able to clearly answer: Is your service on MiCA's CASP list? Are your clients in the EU? If both are yes, have you submitted an application or do you already hold a financial license that allows the notification procedure? If the answer to the first two questions is "yes" and the third is "no," your current situation requires choosing between stopping the provision of that service to EU clients and completing authorization. You cannot continue operating under the old model. MiCA's transition period has ended. There is no "wait and see" middle ground.
